IntelliCommerce Inc is a Texas C-Corporation operating Deal Alley, a direct-to-consumer online store with auction and buy-now functionality. Our principal place of business is 3807 E University Ave, Georgetown, TX 78626. We are the entity responsible for, or controller of, the personal data described in this Policy. Information We Collect

Information you give us directly

  • Identity and contact data, including name, billing and shipping address, email, and phone number.
  • Account data, including username, password, account preferences, and your purchase and bidding history.
  • Transaction data, including items purchased, bid on, won, or returned; order value; and details needed to fulfill and support your order.
  • Payment data as described in Section 6. We do not collect or store your full card number; this is handled by our payment processor.
  • Communications, including messages, support requests, reviews, and survey responses you send us.
  • Marketing preferences, including your consent to receive email and SMS/text messages.

Information we collect automatically

  • Device and usage data, including IP address, device and browser type, operating system, referring or exit pages, pages viewed, clicks, and timestamps.
  • Cookies and similar technologies, as described in Section 4.
  • Approximate location derived from your IP address.

Information from third parties

  • Payment processors, fraud-prevention services, shipping and logistics partners, analytics or advertising providers, and any social or login services you choose to connect.

Note

We do not intentionally collect sensitive personal data, such as government ID numbers, health, biometric, or precise geolocation data, unless you provide it for a specific purpose.

Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies to keep you logged in, remember your cart and preferences, measure traffic, and, where permitted, deliver and measure advertising. You can control cookies through your browser settings.

We recognize and honor browser-based opt-out signals such as Global Privacy Control as a valid request to opt out of the "sale" of personal data and targeted advertising, as required under Texas and other state laws.

How We Share Your Information

We do not sell your personal data for money. We share it only as follows:

  • Service providers acting on our behalf, including payment processors, shipping or fulfillment partners, hosting, customer support, email/SMS platforms, analytics, and fraud prevention. These providers may use your data only to perform services for us.
  • Advertising and analytics partners. Sharing data with these partners for cross-context behavioral advertising may be considered a "sale" or "sharing/targeted advertising" under some state laws. You may opt out as described in Section 10.
  • Legal and safety purposes, including complying with law, court orders, or lawful requests; enforcing our terms; and protecting our rights, users, and the public.
  • Business transfers, including in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

Payment Information

When you pay, your card or bank details are collected and processed directly by our PCI-DSS-compliant payment processor, Stripe. We do not store your full payment card number, CVV, or bank credentials on our servers. We may retain limited information such as the last four digits, card brand, and a tokenized reference to identify your transaction and process refunds.

Email and SMS/Text Messaging

If you opt in, we may send you marketing emails and text messages about promotions, auctions, and new inventory.

  • Consent. By providing your phone number and opting in, you consent to receive autodialed or automated marketing texts. Consent is not a condition of purchase.
  • Opt out. Reply STOP to any text to unsubscribe, or HELP for help. Use the "unsubscribe" link in any email. Message and data rates may apply; message frequency varies.
  • Transactional messages, including order and shipping updates, may still be sent after you opt out of marketing.

Data Retention

We keep personal data only as long as needed for the purposes described here, typically for the life of your account plus the period required to complete transactions, resolve disputes, and meet tax, accounting, and legal obligations. We then delete or de-identify it.

Data Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and access controls. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If we learn of a breach affecting your personal data, we will notify you and authorities as required by law.

Your Privacy Rights

Depending on where you live, you may have some or all of the following rights:

Texas residents have the rights above. Texas requires us to honor universal opt-out signals such as Global Privacy Control. To appeal a decision, contact us at the email below; if your appeal is denied, you may contact the Texas Attorney General.

California residents have the rights above plus the right to limit use of sensitive personal information. We do not sell personal information for money; certain ad-related sharing may qualify as a "sale" or "share," which you may opt out of as described below.

Residents of other states, including Virginia, Colorado, Connecticut, Oregon, and others with comprehensive privacy laws, may have comparable rights. We do not discriminate against you for exercising any of these rights.

  • Access / Know what personal data we hold and how we use it.
  • Correct inaccurate personal data.
  • Delete your personal data, subject to legal exceptions.
  • Portability, including receiving a copy of your data in a usable format.
  • Opt out of the "sale" or "sharing" of personal data, targeted advertising, and certain profiling.
  • Appeal a denial of a request, and non-discrimination for exercising your rights.

How to Exercise Your Rights

Submit a request by emailing team@thedealalley.com. We will verify your identity before responding and will reply within the timeframe required by your state's law, generally 45 days, subject to permitted extensions. An authorized agent may submit a request on your behalf with proof of authorization. There is no fee for a reasonable request.

Do Not Sell or Share / Opt Out of Targeted Advertising

To opt out of targeted advertising and any data sharing that qualifies as a sale or share:

  • Email us at team@thedealalley.com with your opt-out request.
  • Enable Global Privacy Control in your browser, which we will honor automatically where required.
  • Adjust cookie preferences through your browser settings.

Children's Privacy

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal data from children under 13 or sell the data of anyone under 16. If you believe a child has provided us information, contact us and we will delete it.
